PAYMENTS We accept payment via M-Pesa and other methods made available on the Site at checkout. You are responsible for ensuring payment details (such as M-Pesa phone number) are accurate. Orders will only be processed once payment is confirmed. 6. DELIVERY We aim to deliver orders within the timeframes indicated at checkout. Delivery timeframes are estimates and not guaranteed. Risk in goods passes to you upon delivery. Title to goods passes once payment is received in full. 7. RETURNS AND REFUNDS Returns, exchanges, and refunds are governed by our Refund Policy, available on the Site, which forms part of these Terms. 8. HEALTH AND BEAUTY PRODUCTS We sell health, wellness, and beauty products, including cosmetics, skincare, haircare, and personal care items. By purchasing these products, you acknowledge and agree that: (a) Product descriptions, ingredient lists, and usage instructions are provided by manufacturers or suppliers, and you are responsible for reading product labels and instructions before use. (b) You should perform a patch test before first use of any new cosmetic or skincare product and discontinue use immediately if irritation, allergic reaction, or discomfort occurs. (c) You are responsible for disclosing to us or checking with a qualified healthcare professional if you have known allergies, are pregnant or breastfeeding, are under medical treatment, or have a pre-existing skin or health condition, before using any product purchased on the Site. (d) Nothing on the Site, including product descriptions, reviews, or marketing content, constitutes medical advice or a substitute for consultation with a licensed healthcare professional, pharmacist, or dermatologist. (e) Products are sold subject to their manufacturer's expiry date and storage instructions; you should check the expiry date on delivery and store products as indicated on the packaging. (f) All health and beauty products sold on the Site comply, to the best of our knowledge, with applicable Kenyan standards, including those set by the Kenya Bureau of Standards (KEBS) and, where relevant, the Pharmacy and Poisons Board. We do not knowingly sell counterfeit or unregistered products. (g) If you experience an adverse reaction to any product purchased from us, discontinue use immediately, seek medical attention if necessary, and report the incident to us at info@glossedglow.com so we can investigate and, where appropriate, notify the relevant regulatory authority. (h) Due to hygiene and safety requirements, opened or used health and beauty products are subject to the restrictions set out in our Refund Policy. 9. CONSUMER RIGHTS Nothing in these Terms limits your statutory rights under the Consumer Protection Act, 2012, the Sale of Goods Act (Cap. 31), or the Consumer Protection (Electronic Retail Transactions) Regulations, 2023, including your right to receive goods that are of merchantable quality, fit for purpose, and as described. 10. PRODUCT REVIEWS AND USER CONDUCT If you submit reviews or other content, you grant us a non-exclusive, royalty-free licence to use it in connection with the Site. You agree not to post content that is false, defamatory, unlawful, or infringes the rights of others. We may remove content at our discretion. 11. INTELLECTUAL PROPERTY All content on the Site, including logos, text, graphics, and product images, is owned by or licensed to Glossed Glow and is protected by Kenyan and international intellectual property laws. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Kenya. 15.
